Terms of Use

Last Updated: October 28th, 2026

These Terms of Use (these “Terms”) are a legally binding agreement between you and Donation Circle, LLC d/b/a HelpVets (“HelpVets,” “we,” “us,” or “our”) and govern your access to and use of the website located at www.helpvets.com and any related pages, forms, and online features we operate (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms and to our Privacy Policy, available at www.helpvets.com/privacy-policy (the “Privacy Policy”). If you schedule a donation pickup, our Donation Pickup Terms (the “Pickup Terms”) also apply and are incorporated into these Terms by reference. If you do not agree, do not use the Site.

1. About HelpVets; Third Parties

HelpVets operates an online platform that allows donors to schedule free pickups of gently used clothing, household goods, and other eligible items for the benefit of Vietnam Veterans of America (“VVA”) and its donation program partners, including AMVETS (together with VVA, the “Charitable Partners”). Donation pickups are subject to the Pickup Terms.

HelpVets works with third parties, including our Charitable Partners, Pickup Providers (as defined in the Pickup Terms), and other organizations and service providers, and the Site may contain links to or information about third-party organizations and websites. These third parties are independent of HelpVets and maintain their own policies and practices, and HelpVets is not responsible for their content, policies, acts, or omissions. Your interactions with them are solely between you and them. All third-party names and logos are the property of their respective owners.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. The Site is intended for use in the United States only.

3. Changes to These Terms

We may update these Terms from time to time by posting the updated Terms with a new “Last Updated” date. If we make material changes, we may also notify you by email or by a notice on the Site. Your continued use of the Site after changes take effect means you accept the Terms as changed.

4. Privacy

Our collection, use, and disclosure of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

5. Electronic Communications

You agree that agreements, notices, disclosures, and other communications we provide to you electronically, including by email or posting on the Site, satisfy any legal requirement that such communications be in writing.

6. Accounts

If you create an account or submit information through the Site, you agree to provide accurate, current, and complete information, keep any login credentials confidential, and notify us promptly of any unauthorized use. You are responsible for activity that occurs under your account and in connection with your submissions. We may refuse, suspend, or close any account at any time, including if it contains false information or is used in violation of these Terms.

7. Permitted Use and Prohibited Conduct

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Site for your personal, non-commercial purposes. You agree not to:

  • submit false, misleading, or fraudulent information, schedule a pickup for an address you do not control, or impersonate any person;
  • schedule pickups in bad faith, including repeatedly scheduling pickups without placing items out;
  • use bots, scrapers, crawlers, or other automated means to access the Site or collect data from it, including to train artificial intelligence or machine-learning models, without our prior written consent;
  • interfere with, disrupt, probe, or attempt to gain unauthorized access to the Site, our systems, or other users’ information;
  • upload or transmit viruses or other harmful code;
  • copy, modify, frame, mirror, reverse engineer, or create derivative works from any part of the Site;
  • use the name or logo of HelpVets or any Charitable Partner in a way that suggests affiliation or endorsement without written permission;
  • harass, threaten, abuse, or endanger any Pickup Provider, driver, or HelpVets personnel; or
  • use the Site in violation of any law or the rights of others.

If we believe these Terms have been violated, we may take appropriate action, which may include limiting or ending access to the Site and, where required by law, working with the appropriate authorities. You agree that a violation of these Terms may cause HelpVets irreparable harm for which money damages would be inadequate, and that HelpVets may seek injunctive or other equitable relief, without posting a bond, in addition to any other remedies available at law or in equity.

8. Intellectual Property

The Site and all content on it, including text, graphics, logos, images, designs, and software (the “Content”), are owned by HelpVets or its licensors and are protected by intellectual property laws. Except for the limited license in Section 7 (Permitted Use and Prohibited Conduct), no rights are granted to you, and you may not copy, reproduce, distribute, modify, publish, or create derivative works from any Content without our prior written permission.

9. Submissions and Feedback

If you send us comments, reviews, photos, suggestions, or other material (“Submissions”), you grant HelpVets a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, display, and distribute those Submissions for any purpose, without compensation to you. You represent that you have all rights needed to grant this license, and, to the extent permitted by law, you waive any moral rights in your Submissions. We have no obligation to use, review, or retain any Submission and may remove any Submission at any time. Please do not send us confidential information.

10. Information on the Site; No Tax or Legal Advice

Information on the Site is provided for general informational purposes and may change without notice. We do not guarantee that information on the Site, including Service Areas, accepted items, and pickup availability, is complete, accurate, or current, and we may correct errors or omissions at any time without notice. If you believe information on the Site is inaccurate, please let us know. HelpVets does not provide tax, legal, or financial advice.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PICKUP WILL OCCUR ON A PARTICULAR DATE OR AT A PARTICULAR TIME. THE SITE MAY BE UNAVAILABLE FROM TIME TO TIME FOR MAINTENANCE, UPGRADES, TECHNICAL DIFFICULTIES, OR OTHER REASONS, AND WE ARE NOT LIABLE FOR ANY INTERRUPTION, OUTAGE, OR UNAVAILABILITY OF THE SITE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER HELPVETS NOR ITS AFFILIATES, OFFICERS, MEMBERS, EMPLOYEES, VOLUNTEERS, AGENTS, CONTRACTORS, CHARITABLE PARTNERS, OR PICKUP PROVIDERS (THE “HELPVETS PARTIES”) WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, FOR LOST PROFITS, DATA, OR GOODWILL, OR FOR ANY LOSS OF OR DAMAGE TO DONATED ITEMS OR OTHER PROPERTY, ARISING OUT OF OR RELATING TO THE SITE, THE PICKUP TERMS, ANY PICKUP, OR ANY DONATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE HELPVETS PARTIES’ TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE PICKUP TERMS, OR ANY DONATION WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

THESE LIMITATIONS DO NOT APPLY TO THE EXTENT THAT LIABILITY CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the HelpVets Parties from and against all claims, losses, and expenses, including reasonable attorneys’ fees, arising out of (a) your violation of these Terms or the Pickup Terms; (b) your violation of any law or any third party’s rights; (c) any item you place out for donation that you did not own or have authority to donate, or that is hazardous, recalled, or prohibited; (d) any claim by a landlord, property manager, homeowners’ association, neighbor, co-occupant, or other third party relating to the placement of items or access to the pickup location you designated or authorized; or (e) your fraud, negligence, or willful misconduct. We may assume the exclusive defense of any such matter at your expense, and you will cooperate with us. You may not settle any such matter without our prior written consent.

14. Termination; Suspension

We may suspend or terminate your access to the Site or the pickup service, or modify or discontinue the Site or the pickup service, at any time and for any reason, with or without notice, and without liability to you. Sections 8 (Intellectual Property) through 17 (Contact Us), and any other provision that by its nature should survive, will survive termination.

15. Governing Law; Venue; Jury Trial Waiver

These Terms, the Pickup Terms, and any dispute, claim, or controversy arising out of or relating to them, the Site, or any pickup or donation are governed by the laws of the Commonwealth of Virginia without regard to its conflict of law principles. Any such action will be brought exclusively in the state or federal courts located in that state, and you consent to the personal jurisdiction and venue of those courts. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND HELPVETS EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY SUCH ACTION, AND YOU AGREE THAT ANY SUCH ACTION WILL BE BROUGHT ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. To the extent permitted by law, any claim must be brought within one (1) year after it arises, or it is permanently barred.

16. General

These Terms, the Pickup Terms, and the Privacy Policy are the entire agreement between you and HelpVets regarding their subject matter. If any provision is unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms, but we may assign them without restriction. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship. Neither party is liable for delays caused by events beyond its reasonable control, including weather, natural disasters, government action, labor disputes, vehicle or fuel shortages, and utility or internet failures. Headings are for convenience only, and “including” means “including without limitation.”

Donation Pickup Terms

Last Updated: October 28th, 2026

These Donation Pickup Terms (these “Pickup Terms”) apply when you schedule a donation pickup through HelpVets or place items out for pickup. They supplement and are part of the HelpVets Website Terms of Use (the “Website Terms”), including the governing law, venue, and jury trial waiver in Section 15 of the Website Terms. Capitalized terms not defined here have the meanings given in the Website Terms. If these Pickup Terms conflict with the Website Terms, these Pickup Terms control with respect to pickups and donations. We may update these Pickup Terms in the same manner as the Website Terms. Your representations and the provisions of these Pickup Terms regarding ownership, risk of loss, and limitation of responsibility survive the completion of any pickup and any termination of your access.

1. Pickup Process

You can request a free donation pickup through the Site. Pickups are available only in the geographic areas shown on the Site (the “Service Areas”), which may change from time to time. Pickups may be performed by HelpVets, the Charitable Partners, or drivers, contractors, or other third parties working on their behalf (each, a “Pickup Provider”). To the fullest extent permitted by law, HelpVets is not responsible for the acts or omissions of any Pickup Provider that is not HelpVets. To arrange your pickup, we may share the information you provide with the applicable Pickup Provider and Charitable Partner, as described in our Privacy Policy.

2. Scheduling; No Guarantee

Submitting a pickup request does not guarantee a pickup. Pickup dates, times, and windows are estimates, are not guaranteed, and may vary based on routes, weather, local demand, and other factors. We or the Pickup Provider may accept, decline, reschedule, skip, or cancel any pickup at any time and for any reason, including because of weather, safety concerns, access conditions, vehicle or staffing issues, or Service Area limitations. We may also change the Service Areas, pickup procedures, accepted items, and any other aspect of the pickup service at any time. If a pickup is missed or late, we may, but are not required to, offer to reschedule it, and to the fullest extent permitted by law, the HelpVets Parties have no other liability for any declined, missed, late, skipped, or cancelled pickup.

3. Preparing and Placing Your Donation

For each pickup, you agree to follow the preparation and placement instructions provided on the Site or when you schedule, which may change from time to time, including to:

  • pack items in bags or boxes, each clearly marked as a donation;
  • place items at the location and by the time specified on the Site or when you schedule, and not inside your home or any other enclosed or non-accessible area;
  • make sure items are visible and safely accessible, and that each bag, box, or item can reasonably be lifted and carried by one person; and
  • if you live in an apartment, condominium, or community with rules about leaving items outside, follow all such rules.

Pickup Providers will not enter your home to collect items. Do not leave cash, checks, keys, or other valuables with your donation. A pickup may be declined or skipped if items are not accessible, not properly prepared, or not eligible donations.

4. Accepted and Prohibited Items

Accepted items are described on the Site and may change from time to time. We generally accept clothing, shoes, accessories, household goods, small furniture, small appliances, electronics, books, toys, and similar items that one person can reasonably lift and carry, but we may decline any item for any reason. We do not accept:

  • items containing fuel of any kind;
  • hazardous materials, including chemicals, paint, propane or other gas tanks, firearms, ammunition, and explosives;
  • items that are recalled, wet, moldy, soiled, infested, or broken;
  • CRT, DLP, or other older televisions;
  • cash, checks, gift cards, or other valuables; and
  • any other item not listed on the Site as eligible, or whose donation or transport is restricted by law.

Pickup Providers may leave behind, without notice, any item that does not meet these guidelines or that they believe is not suitable for pickup. Items left behind remain your property and responsibility.

5. Your Representations

By scheduling a pickup or placing items out, you represent that (a) you are the rightful owner of the items or are otherwise authorized to donate them, and they are free of any lien or claim by any other person; (b) you are donating the items voluntarily and without expectation of compensation; (c) the items are not prohibited items and may lawfully be donated; (d) you have removed all personal documents, information, and valuables from the items, including from pockets, bags, and electronic devices; and (e) you are authorized to place items at the pickup location and to permit Pickup Providers to access that location to collect them.

6. Ownership; No Returns

Items you place out remain your property, and at your risk, until they are collected. Once collected, donated items become the property of HelpVets, or the applicable Charitable Partner or its designee and are not recoverable. Donations are final, and donated items cannot be returned, retrieved, or exchanged. Please double-check your bags and boxes before placing them out.

7. Items Left Outside; Mistaken Pickup; Theft

Placing items outside for pickup is at your sole risk. To the fullest extent permitted by law, the HelpVets Parties are not responsible for (a) loss, theft, or damage to items, including from weather, before they are collected; (b) the collection of items placed at or near the pickup location, including items that were not marked as donations, were placed out by someone else, or were placed out by mistake; (c) items, personal information, or valuables accidentally included in a donation; (d) items taken by anyone other than a Pickup Provider; or (e) items that are left behind or not collected for any reason.

8. Use of Donated Items

Donated items may be sold through thrift operations, sold through wholesale channels, recycled, repurposed, or otherwise processed consistent with the mission and practices of HelpVets or the applicable Charitable Partner. We do not guarantee that any item will be used, sold, recycled, or distributed in any particular manner.

9. Donation Receipts; Tax Matters

A donation receipt may be provided at pickup or made available through the Site, as described on the Site. Receipts are provided for your records and reflect a general description of donated items only. HelpVets, the Pickup Providers, and the Charitable Partners do not appraise or guarantee the value of donated items, and receipts are not tax advice. You are solely responsible for determining whether your donation is deductible and the value you may claim and for keeping your own records, and you should consult a qualified tax professional.

10. Cancelling or Changing a Pickup

You may cancel or change a scheduled pickup as described on the Site or in your pickup confirmation. If you repeatedly schedule pickups and do not place items out, or otherwise misuse the pickup service, we may limit or refuse future pickups for you or your address.

11. Concerns About a Pickup

If you have a concern about a pickup or a Pickup Provider, please contact us promptly and include your pickup address and date, a description of the concern, and photos if available. We may share your concern with the applicable Pickup Provider or Charitable Partner.

12. Website Terms Apply

The disclaimers, limitation of liability, indemnification, governing law, venue, jury trial waiver, and general provisions of the Website Terms apply to all pickups and donations.
